Information about Ordering and Returns

1. Terms of Sale Validity

1.1 The terms of sale apply to purchases made from the online store www.smarthomeoffice.eu between the buyer (hereinafter referred to as the ‘Consumer’) and the company Smart Home Office OÜ (hereinafter referred to as the ‘Online Store smarthomeoffice.eu’) for goods and services.

1.3 In addition to these terms, the purchases made from the smarthomeoffice.eu online store are governed by the Law of Obligations Act (hereinafter ‘LOA’), the Consumer Protection Act (hereinafter ‘CPA’), and other applicable laws in the Republic of Estonia.

2. Price Information

2.1 All prices listed in the Online Store smarthomeoffice.eu include a 22% value-added tax.

2.4 If an order is placed before changes to the terms of sale or prices, the legal relations between the Consumer and the Online Store smarthomeoffice.eu shall be governed by the conditions applicable at the time of placing the order.

3. Placing an Order

3.1 Add your desired products to the Online Store shopping cart.

The responsible processor of personal data is Smart Home Office OÜ, which forwards the necessary personal data for making payments to the authorized processor.

3.5 Fill in the data and the cells on the order confirmation page carefully, as the speedy and trouble-free delivery of your purchased products and the subsequent resolution of disputes and claims depend on the accuracy and correctness of the information provided.

3.6 Tick the box that says “I have read the Terms of Sale of the Website and our Privacy Policy and I agree with them”.

3.7 Orders placed in the Online Store are processed every working day from 10:00 a.m. to 4:00 p.m. If an order is placed after 12:00 on a Friday, the order may not be processed until the following Monday.

3.8 On average, it takes the Online Store smarthomeoffice.eu 8-10 weeks to prepare and deliver the order.

4. Entry into Force of the Sales Contract

4.1 With the contract of sale of goods, the Online Store smarthomeoffice.eu undertakes to hand over to the Consumer the existing Goods, which are manufactured or acquired by the Online Store smarthomeoffice.eu in the future, and to enable the transfer of ownership to the Consumer. The Consumer, in turn, undertakes to pay the Online Store smarthomeoffice.eu the amount indicated on the invoice for the Goods and to accept the Goods.

4.2 Orders that have not been paid for will be canceled 7 days after the order was placed.

4.3 The sales contract enters into force after the payment made by the Consumer has been received in the bank account of the Online Store smarthomeoffice.eu.

5. Delivery

5.1 After the sales contract enters into force, the order is put into operation, and when it is ready, smarthomeoffice.eu hands it over to the company’s logistics partners for delivery. It is no longer possible to cancel an order that has already been placed.

5.2 The delivery terms shown on the smarthomeoffice.eu website are valid from the moment the order amount is received in the Online Store smarthomeoffice.eu bank account. On average, delivery takes 8-10 weeks.

5.3 In order to deliver without delays, you must be diligent and provide true and valid data when entering the delivery information during the order completion. 6. Right of Return

6.1 After receiving the order, the Consumer has the right to withdraw from the contract concluded with the Online Store smarthomeoffice.eu without giving a reason within 14 days. If you wish to return the Product, you must first fill out the return form. In the letter, please state the order number, the customer’s details, and the name of the product that you want to return.

6.2 The Goods to be returned must be undamaged, unused, and in the original packaging.

6.3 The goods can be returned by contacting info@smarthomeoffice.eu. There is no additional cost to you.

6.4 The Online Store smarthomeoffice.eu shall return all fees received from the buyer under the contract upon receipt of the returned Goods to the buyer without delay, but no later than 14 days after receiving the withdrawal statement. The Online Store smarthomeoffice.eu can refuse to make refunds until the Goods have been received.

6.5 In order to use the 14-day right of return, the ordered Goods may not be used in any other way than is necessary to verify the nature, characteristics, and functioning of the Goods in the manner permitted for testing the Goods in a physical store.

6.6 Please note that tailored Goods, which are made specifically for the customer, cannot be returned.

7. Force Majeure

7.1 The Online Store smarthomeoffice.eu is not responsible for damages caused to the Customer or the delay in the delivery of the Goods if the damage or the delay in the delivery of the Goods is due to circumstances that the Online Store smarthomeoffice.eu could not influence or foresee.

8. Processing of Personal Data

8.1 The Online Store smarthomeoffice.eu is the responsible processor of personal data, which transmits the personal data necessary for making payments to the authorized processor.

8.2 By entering data in the Online Store, the Consumer grants the right to collect and process the Consumer’s personal data (name, contact phone number, home address, e-mail address) with the corresponding confirmation.

8.4 The Consumer has the right to prohibit the collection and use of his personal data at any time, unless it is necessary to collect a claim arising from the contract or to deliver the Goods.

8.5 The use of electronic personal data for direct mail takes place only if the Consumer has given separate consent for this.

8.6 Encrypted data communication with banks when paying for purchases ensures the security of the Consumer’s personal bank credentials, and the Online Store smarthomeoffice.eu does not have access to them.

9. The Consumer’s Right to Appeal to the Consumer Protection and Technical Supervision Board

9.1 If the Online Store smarthomeoffice.eu has refused to resolve the Consumer’s complaint or the Consumer does not agree with the solution proposed by the Online Store and considers that his rights have been violated or his interests have been damaged, the Consumer may submit a complaint to the Consumer Complaints Commission through the Consumer Protection and Technical Supervision Agency or to the court. To solve problems arising in the member states of the European Union, contact the Consumer Advice Center of the European Union or make a statement on the European Union consumer dispute resolution platform.

10. The Right to File a Claim

10.1 The Online Store smarthomeoffice.eu is responsible for non-compliance of the Goods sold to the buyer with the terms of the contract or a deficiency that already existed at the time of handing over the Goods and which appears within two years from the handing over of the Goods to the buyer. During the first six months from the handing over of the Goods to the buyer, it is assumed that the defect already existed at the time of handing over the Goods. It is the Online Store’s responsibility to refute the corresponding assumption.

The buyer has the right to contact the Online Store smarthomeoffice.eu within two months at the latest, by sending an e-mail to info@smarthomeoffice.eu or by calling +372 5618 7453.

10.2 The Online Store smarthomeoffice.eu is not responsible for defects that have occurred after the Goods have been handed over to the buyer. If the Goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective Goods. If it is not possible to repair or replace the Product, the Online Store will return all fees associated with the sales contract to the buyer. The Online Store responds to the consumer’s complaint in writing or in a form that enables written reproduction within 15 days.
